1. Introduction

Welcome to Kanom. These Terms of Service ("Terms") govern your access to and use of Kanom's services ("Services"), provided by Ray Harris, sole proprietor registered in California, USA ("Kanom," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Eligibility

• Age Requirement: You must be at least 13 years old to use our Services. If you are under 18, you must have the consent of your parent or legal guardian.
• Geographical Restrictions: Our Services are available to users worldwide; however, game servers are hosted exclusively in the United States.

3. Service Description

Kanom provides online game hosting services managed through an interactive Discord bot. Users can:

• Add funds to their Kanom account.
• Use Discord commands to start and stop game servers.
• Pay only for the time their game server is running, calculated at $0.0011 per minute.

4. Account Registration and Management

• Discord Integration: Your Kanom account is linked to your Discord server where the Kanom bot is added. No separate registration is required.
• Account Security: You are responsible for maintaining the confidentiality of any passwords or access codes related to your game server. Kanom is not liable for any loss or damage arising from your failure to protect your account information.

5. Payment Terms

• Payment Methods: We accept payments via credit card and other methods supported by Stripe.
• Adding Funds: You can add funds to your Kanom account at any time using your unique payment URL. Anyone with this URL can add funds to your account.
• Pricing Structure: Charges are incurred at a rate of $0.0011 per minute while your game server is running. Usage is calculated when the server is shut down, and the corresponding amount is deducted from your account balance.
• Initial Credit: Each new account starts with a complimentary $0.25 credit.
• Insufficient Funds: If your account balance reaches $0 or below, you will be unable to start a new game server until additional funds are added such that the balance is above zero.
• Refund Policy: All sales are final. We do not offer refunds or credits for any reason, except as required by law.

6. User Conduct and Acceptable Use

• Prohibited Activities:
  • Using the game servers for purposes other than playing the intended game.
  • Engaging in any activity that violates applicable laws or regulations.
  • Attempting to disrupt or compromise the integrity or security of the Services.
• Enforcement Actions: Violation of these Terms may result in immediate suspension or termination of your access to the Services without notice.

7. Intellectual Property Rights

• Kanom's IP: All content, trademarks, and data on the Kanom website and Services are the property of Kanom and are protected by intellectual property laws.
• User Content: You retain all rights to any content you upload or create while using our Services, such as game save files. Kanom does not claim ownership of your content but may use it solely for the purpose of providing and improving the Services.

8. Data Collection and Privacy

• Personal Information: We collect minimal personal information necessary to provide the Services. For details, please review our Privacy Policy.
• Data Usage: Your data is used to facilitate account management, payment processing, and service provisioning.
• Third-Party Sharing: We do not share your personal information with third parties, except as required by law or as necessary to provide the Services.

9. Service Availability and Disclaimers

• No Uptime Guarantee: The Services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability of game servers.
• Spot Instances: Our game servers run on Google Cloud spot instances, which may be preempted at any time without notice.
• Limitation of Liability: Kanom is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

10. Termination

• By User: You may stop using the Services at any time.
• By Kanom: We reserve the right to suspend or terminate your access to the Services for any reason, including violation of these Terms.
• Effect of Termination: Upon termination, your access to the Services will cease, but you will remain responsible for any outstanding charges on your account.

11. Dispute Resolution

• Governing Law: These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law principles.
• Legal Actions: Any legal action arising out of these Terms shall be brought in the federal or state courts located in California.

12. Changes to the Terms

• Modification Rights: We may update these Terms from time to time. When we make changes, we will notify users in the official Kanom Discord server.
• Acceptance of Changes: Continued use of the Services after changes are posted constitutes your acceptance of the new Terms.
